Los Estados confederados proyectan la existencia de un doble sistema normativo: federal y local. Esto provoca el surgimiento de colisiones y contradicciones entre ambos sistemas, lo que se pensaría debería ser resuelto por el derecho internacional, atendiendo el principio de subsidiariedad, no obstante, esto no siempre es así, ya sea porque el derecho internacional no regule ese caso concreto o bien, porque el Estado en cuestión no haya otorgado su consentimiento y la respuesta no le sea vinculante. Estas reflexiones invitan (...) a contrastar la naturaleza de las normas del derecho local y del derecho internacional, pues mientras que las primeras son asociativas, dado que no necesariamente requieren ser consentidas para ser vinculantes, las segundas, aparentemente, sí requieren el consentimiento de los Estados para que tengan efectos vinculantes. En este artículo pretendemos postular una posible solución al problema del conflicto entre los distintos órdenes normativos, partiendo desde una postura cuasi-voluntarista. Las obligaciones cuasi-voluntarias son aquellas que no surgen del consentimiento, pero tampoco completamente de los roles que tienen los Estados en el sistema internacional. Estas obligaciones nacen en el núcleo de grupos dominantes, a los que llamaremos grupos autocontenidos en el ámbito internacional, que tienen como rol la creación y socialización de las normas y obligaciones de derecho internacional, logrando que los otros grupos simplemente las sigan como si tuvieran un deber de hacerlo. Para ello, servirá como referencia el análisis del caso de las disimiles normas migratorias entre California y Texas dentro de Estados Unidos. (shrink)

Esta obra se concentra en cuatro temas cruciales de la formación de docentes, tanto antes como durante el servicio y en la enseñanza en diferentes áreas y niveles educativos. En primer lugar, se aborda el asunto de las creencias que los docentes tienen sobre el proceso educativo, las cuales parecen influir en la práctica profesional que estos desarrollan y, por lo tanto, deberían recibir la atención explícita de los procesos de formación de docentes que deseen promover prácticas específicas. El segundo (...) tema de la obra es la relación entre la formación de docentes y la política pública que la rige. En particular, se analizan las reformas curriculares implementadas por varias licenciaturas en universidades privadas colombianas, en respuesta a reformas a la normatividad sobre las condiciones de calidad que a las que deben ajustarse todas las licenciaturas del país. El tercer tema analizado es en qué medida los docentes en educación superior van más allá del dominio de su saber disciplinar atribuyendo importancia a la pedagogía, la didáctica y la práctica reflexiva en su propia práctica docente. Finalmente, se discuten aspectos de la formación de docentes relacionados con los procesos vividos y los retos encontrados por los docentes al entrar en la profesión, su socialización en la comunidad docente, sus identidades como maestros y su motivación para ser docentes. Vale la pena señalar que las contribuciones a este libro comparten el uso de metodologías cualitativas y presentan los resultados de historias de vida, entrevistas, observaciones, y análisis documentales, entre otros. I show that centered propositions—also called de se propositions, and usually modeled as sets of centered worlds—pose a serious problem for various versions of Lewis's Principal Principle. The problem, put roughly, is that in scenarios like Elga's `Sleeping Beauty' case, those principles imply that rational agents ought to have obviously irrational credences. To solve the problem, I propose a centered version of the Principal Principle. My version allows centered propositions to be objectively chancy.

When artificial intelligence (AI) is used to make high-stakes decisions, some worry that this will create a morally troubling responsibility gap—that is, a situation in which nobody is morally responsible for the actions and outcomes that result. Since the responsibility gap might be thought to result from individuals lacking knowledge of the future behavior of AI systems, it can be and has been suggested that deploying explainable artificial intelligence (XAI) techniques will help us to avoid it. These techniques provide humans (...) with certain forms of understanding of the systems in question. In this paper, I consider whether existing XAI techniques can indeed close the responsibility gap. I identify a number of significant limits to their ability to do so. Ensuring that responsibility for AI-assisted outcomes is maintained may require using different techniques in different circumstances, and potentially also developing new techniques that can avoid each of the issues identified. I propose a `stage theory’ of groups: a group is a fusion of group-stages, where a group-stage is a plurality of individuals at a world and a time. The stage theory consists of existence conditions, identity conditions, and parthood conditions for groups.

The insight a patient shares into their own psychosis is fundamental to their condition - it goes to the heart of what we understand 'madness' to be. Can a person be expected to accept treatment for a condition that they deny they have? Can a person be held responsible for their actions if those actions are inspired by their own unique perceptions and beliefs - beliefs that no-one else shares? The topic of insight in schizophrenia and related disorders has become (...) a major focus of research in psychiatry and psychology. It has important clinical implications in terms of outcome, treatment adherence, competence, and forensic issues. In order to study 'insight' a broad perspective is required. This involves applying knowledge from the cognitive and brain sciences, as well as from philosophy and the social sciences. Insight and Psychosis comprises a series of in-depth, well-referenced, scholarly overviews from each of these perspectives with a strong empirical foundation - including in some cases the presentation of new data and meta-analysis of the published literature. These are integrated and synthesised by the editors, both acknowledged experts in the field. Suppose that, for reasons of animal welfare, it would be better if everyone stopped eating chicken. Does it follow that you should stop eating chicken? Proponents of the “inefficacy objection” argue that, due to the scale and complexity of markets, the expected effects of your chicken purchases are negligible. So the expected effects of eating chicken do not make it wrong. -/- We argue that this objection does not succeed, in two steps. First, empirical data about chicken production tells us (...) that the expected effects of consuming *many* chickens are not negligible. Second, this implies that the expected effect of consuming one chicken is ordinarily not negligible. *Parity* between your purchase and other counterfactual purchases and *uncertainty* about others’ consumption behavior each tend to pull the expected effect of a single purchase toward the average large scale effect. There have been several recent attempts to think about psychological kinds as homologies. Nevertheless, there are serious epistemic challenges for individuating homologous psychological kinds, or cognitive homologies. Some of these challenges are revealed when we look at competing claims of cognitive homology. This paper considers two competing homology claims that compare human anger with putative aggression systems of nonhuman animals. The competition between these hypotheses has been difficult to resolve in part because of what I call the boundary problem: boundaries (...) between instances of psychological kinds (e.g., anger and fear) cannot be directly observed. Thus, there are distinctive difficulties for individuating psychological kinds across lineages. I draw four conclusions from this case study: First, recent evidence from the neuroscience of fear suggests that one of the proposed homologies involves a straightforward conflation of anger and fear. Second, this conflation arises because of the boundary problem. Third, there is an implicit constraint on the operational criteria that is easy to overlook in the psychological case. In this case, ignoring the constraint is part of the problem. Fourth, this is a clear case in which knowledge of homology cannot be accumulated piecemeal. Identifying homologs of human anger requires identifying homologs of fear. (shrink)

El Informe que Marcelo Spinola y Maestre, arzobispo de la sede hispalense, remitía a la Santa Sede, a petición de ésta, en 1901, reflejaba de modo fiel y detallado la actividad general de las instituciones religiosas masculinas y femeninas. Dicho informe desmonta una serie de prejuicios anticlericales muy difundidos en la época (...) en torno a la educación católica. Dense pairs of geometric topological fields have tame open core, that is, every definable open subset in the pair is already definable in the reduct. We fix a minor gap in the published version of van den Dries's seminal work on dense pairs of o-minimal groups, and show that every definable unary function in a dense pair of geometric topological fields agrees with a definable function in the reduct, off a small definable subset, that is, a definable set internal to (...) the predicate. For certain dense pairs of geometric topological fields without the independence property, whenever the underlying set of a definable group is contained in the dense-codense predicate, the group law is locally definable in the reduct as a geometric topological field. If the reduct has elimination of imaginaries, we extend this result, up to interdefinability, to all groups internal to the predicate. (shrink)

In this essay, I consider an evolutionary debunking argument (EDA) that purports to undermine the epistemic justification of the belief in the reliability of our belief-forming processes, and an evolutionary vindicating argument (EVA) that seeks to establish that such a belief is epistemically justified. Whereas the EDA in question seems to fall prey to crippling self-defeat, the EVA under consideration seems to fall prey to vicious circularity. My interest in those arguments and the problems they face lies in what they (...) might tell us about the possibly aporetic nature of reason. For, if we take the EDA and the EVA in question to consist of true or plausible premises and valid inferences at which we arrive through a meticulous use of reason, then their falling victim to either crippling self-defeat or vicious circularity might be regarded as a sign that, when we push rational reflection on the reliability, or lack thereof, of our belief-forming capacities to the limit, we end up in a situation of aporia from which there seems to be no escape. We present a novel model of individual people, online posts, and media platforms to explain the online spread of epistemically toxic content such as fake news and suggest possible responses. We argue that a combination of technical features, such as the algorithmically curated feed structure, and social features, such as the absence of stable social-epistemic norms of posting and sharing in social media, is largely responsible for the unchecked spread of epistemically toxic content online. Sharing constitutes a distinctive communicative act, (...) governed by a dedicated norm and motivated to a large extent by social identity maintenance. But confusion about this norm and its lack of inherent epistemic checks lead readers to misunderstand posts, attribute excess or insufficient credibility to posts, and allow posters to evade epistemic accountability—all contributing to the spread of epistemically toxic content online. This spread can be effectively addressed if people and platforms add significantly more context to shared posts and platforms nudge people to develop and follow recognized epistemic norms of posting and sharing. For the past fifty years anxiety over naturalism has driven debates in social theory. One side sees social science as another kind of natural science, while the other rejects the possibility of objective and explanatory knowledge. _Interpretation and Social Knowledge_ suggests a different route, offering a way forward for an antinaturalist sociology that overcomes the opposition between interpretation and explanation and uses theory to build concrete, historically specific causal explanations of social phenomena.

An increasingly prevalent approach to studying human cognition is to construe the mind as optimally allocating limited cognitive resources among cognitive processes. Under this bounded rationality approach (Icard in Philos Sci 85(1):79–101, 2018; Simon in Utility and probability, Palgrave Macmillan, 1980), it is common to assume that resource-bounded cognitive agents approximate normative solutions to statistical inference problems, and that much of the bias and variability in human performance can be explained in terms of the approximation strategies we employ. In this (...) paper, we argue that this approach restricts itself to an unnecessarily narrow scope of cognitive models, which limits its ability to explain how humans flexibly adapt their representations to novel environments. We argue that more attention should be paid to how we form our cognitive representations in the first place, and advocate for pluralistic framework which jointly optimizes over both representations and algorithms for manipulating them. We identify several fundamental trade-offs that manifest in this joint optimization, and draw on recent work to motivate a unified formal framework for this analysis. We illustrate a simplified version of this analysis with a case study in social cognition, and outline several new directions for research that this approach suggests. (shrink)

This paper deals with two different problems in which infinity plays a central role. I first respond to a claim that infinity renders counting knowledge-level beliefs an infeasible approach to measuring and comparing how much we know. There are two methods of comparing sizes of infinite sets, using the one-to-one correspondence principle or the subset principle, and I argue that we should use the subset principle for measuring knowledge. I then turn to the normalizability and coarse tuning objections to fine-tuning (...) arguments for the existence of God or a multiverse. These objections center on the difficulty of talking about the epistemic probability of a physical constant falling within a finite life-permitting range when the possible range of that constant is infinite. Applying the lessons learned regarding infinity and the measurement of knowledge, I hope to blunt much of the force of these objections to fine-tuning arguments. (shrink)

People increasingly form beliefs based on information gained from automatically filtered Internet ‎sources such as search engines. However, the workings of such sources are often opaque, preventing ‎subjects from knowing whether the information provided is biased or incomplete. Users’ reliance on ‎Internet technologies whose modes of operation are concealed from them raises serious concerns about ‎the justificatory status of the beliefs they end up forming. Yet it is unclear how to address these concerns ‎within standard theories of knowledge and justification. (...) To shed light on the problem, we introduce a ‎novel conceptual framework that clarifies the relations between justified belief, epistemic responsibility, ‎action, and the technological resources available to a subject. We argue that justified belief is subject to ‎certain epistemic responsibilities that accompany the subject’s particular decision-taking circumstances, ‎and that one typical responsibility is to ascertain, so far as one can, whether the information upon which ‎the judgment will rest is biased or incomplete. What this responsibility comprises is partly determined by ‎the inquiry-enabling technologies available to the subject. We argue that a subject’s beliefs that are ‎formed based on Internet-filtered information are less justified than they would be if she either knew how ‎filtering worked or relied on additional sources, and that the subject may have the epistemic ‎responsibility to take measures to enhance the justificatory status of such beliefs.‎. Why would God institute the practice of efficacious petitionary prayer? Why would God not simply give us what we need before we ask? I examine recently proposed solutions to this puzzle and argue that they are inadequate to explain why an omniscient and perfectly good God would act differently in response to prayer. I propose that God has reasons to not always maximize a creature’s good, even in a sinless world, and that petitionary prayer functions as a means to reward (...) those who trust God, to enable us to actively love those we cannot otherwise help, and to give the petitioner personal evidence of God’s existence and care for her, creating a virtuous cycle of increasing faith. I refine this proposal by responding to several objections involving human responsibility and the epistemology of divine action. Along the way, I offer several ways petitioners can recognize God’s having answered a prayer and how God might help us with some common obstacles to prayer. (shrink)

My aim in this paper is to give a philosophical analysis of the relationship between contingently available technology and the knowledge that it makes possible. My concern is with what specific subjects can know in practice, given their particular conditions, especially available technology, rather than what can be known “in principle” by a hypothetical entity like Laplace’s Demon. The argument has two parts. In the first, I’ll construct a novel account of epistemic possibility that incorporates two pragmatic conditions: responsibility and (...) practicability. For example, whether subjects can gain knowledge depends in some circumstances on whether they have the capability of gathering relevant evidence. In turn, the possibility of undertaking such investigative activities depends in part on factors like ethical constraints, economical realities, and available technology. In the second part of the paper, I’ll introduce “technological possibility” to analyze the set of actions made possible by available technology. To help motivate the problem and later test my proposal, I’ll focus on a specific historical case, one of the earliest uses of digital electronic computers in a scientific investigation. I conclude that the epistemic possibility of gaining access to scientific knowledge about certain subjects depends (in some cases) on the technological possibility for making responsible investigations. El concepto de trastorno mental permite justificar intervenciones médicas, psicológicas y judiciales. Además, facilita a la/el consultante acceder a tratamientos mediante reembolsos o programas de salud pública, y por otro lado, podría conllevar estereotipos sociales. No obstante, el significado de dicho concepto no ha dejado de suscitar debate. En el presente artículo argumentaré que los trastornos de personalidad, tal como son definidos en el DSM-5, no cumplen con los criterios de patología de las propuestas principales (i.e. teoría bio-estadística de la (...) salud, disfunción dañina, o entidad patológica) debido a tres razones independientes: (i) no se han propuesto dis/funciones a la base de cada trastorno y, dado el estado del arte de la psicología evolucionista, es poco probable que se pueda llevar a cabo ese programa en el futuro; (ii) el concepto de daño (distrés, perjuicio) aplicable a los trastornos de personalidad es constitutivamente social (aunque no exclusivamente social), por lo que resulta más adecuado hablar de grados de discapacidad que de trastornos del individuo; y (iii) que la ausencia de condiciones patognomónicas para cada trastorno, junto a la elevada comorbilidad y multimorbilidad entre trastornos de personalidad, horada la validez de la nosología actual y de los diagnósticos diferenciales. Propondré como solución la eliminación de los trastornos de personalidad de la nosología psiquiátrica. Eliminar los trastornos de personalidad no equivale a desconocer el sufrimiento de las personas diagnosticadas, ni a ignorar que dicho sufrimiento precede a, –y no acaba con la disolución de– la etiqueta diagnóstica. Por ello, se propondrá una reconceptualización de dicho sufrimiento en términos de discapacidad, entendida desde el modelo social, y que no presupone patología. (shrink)
